Game of Skill Terms and Conditions for the 2Wheels Ride with Kevin Magee
1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions and those of Australian Motorcycle Tours and any suppliers of any element of the prize. Entries must comply with these conditions to be valid.
2. Entry is open to residents of Australia aged 18 years or older who fulfil entry requirements as stated in clause 3. Employees and their immediate families of the Promoter and its agencies associated with this competition are not eligible to enter this competition.
3. To enter participants must answer the following question in 25 words or less “why do you want to travel to & experience the action of the 2010 IVECO Australian Motorcycle Grand Prix with a 2wheels ambassador and Kevin Magee?” the must send their answer by:
a. Email with the subject line: Ride with Kevin Magee along with their full name, address, contact number and answer in the body of the email to info@twowheelsmagazine.com.au
b. Participants must have their own road worthy motorcycle in which to ride in convoy to the event.
c. The motorcycle and rider(s) must have a current and valid motorcycle license and vehicle insurance.
d. Participants must be available to partake in the event as per the dates stipulated and must must health, and safety requirements as per clause 9.
4. The competition commences at 00.01 (AEST) on Wednesday 25th August 2010 and closes at 23.59 (AEST) on Tuesday 21st September 2010 (“Entry Period”). Multiple entries will be accepted, however, each entry must be sent in as a separate correspondence and an original entry.
5. Entries must be received by the Promoter during the Entry Period. Entries received after the end date will not count towards the competition.
6. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity. The best entry as determined by the judges, will win a prize.
7. Judging will take place from 9:00am (AEST) on Wednesday 22nd September 2010 at News Magazines 180 Bourke Road, Alexandria, NSW 2015. Entries will be judged by a panel of judges from News Magazines.
8. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party.
9. The answer judged to be the best will win a ride with Kevin Magee to the 2010 IVECO Australian Motorcycle Grand Prix (the Event) PLUS Win a legends VIP experience at the Event for the winner and 3 guests. The prize will comprise the following:
a. Riding down to Phillip Island with Kevin Magee and Australian Motorcycle Tours on the 2010 OZGP Tour.
i. The OZGP Tour will commence on the North Coast of NSW and will take in roads such as the Oxley Highway, Thunderbolts Way, The Putty, the Old Hume Highway, Macquarie Pass, Kangaroo Valley, Bermi-Tathra, Brown Mtn, The Alpine Way, Murray River Rd, Powers lookout, The Black Spur and many more fantastic "Bike Roads".
ii. The 2010 OZGP Tour Itinerary (Subject to confirmation):
Friday October 8th: Arrive at Tour Start (Wauchope, NSW)
Saturday October 9th: 9am Ride to Gloucester
Sunday October 10th: 9am Ride to Sydney
Monday October 11th: 9am Ride to Batemans Bay
Tuesday October 12th: 9am Ride to Thredbo
Wednesday October 13th: 9am Ride to Wangaratta
Thursday October 14th: 9am Ride to Phillip Island
Winner and guest(s) will need to make their own way to the Tour Start point in Wauchope
b. Twin Share Accommodation from 8th-14th October 2010 for 4 people.
c. Breakfast from 8th - 14th October 2010 for 4 people
d. Twin Share Accommodation from 14-18th October 2010 for 4 people
e. Grandstand tickets to the Event for all three days valued at $265 inc GST per person .
f. A pit Lane Walk with Kevin McGee valued at up to $1000 per person
g. A paddock tour with Robbie Phillis valued at up to $1500 per person
h. A tour of the legends facility with Mick Doohan and Wayne Gardner valued at up to $750 per person
i. Pit Canopy session with Mick Hone valued at up to $2000 per person
j. MotoGP Merchandise Pack valued at up to $150 per person
k. The prize must be taken on Friday 8th October.
l. The winner’s “guest(s)” must be 18 years of age or older.
m. All riders must be in good health and may be subjected to a medical examination.
n. Winners must at all times obey the road rules and wear the appropriate safety gear, during the ride with Kevin MaGee and must follow all safety instructions that are advised to them. Failure to do so may result in the whole part of the prize being forfeited.
o. Winner and Guest(s) must abide by the terms and conditions as set out by Australian Motorcycle Tours who are the organisers of the tour. Full terms and conditions can be found at http://www.australianmotorcycletours.com/Terms.htm. The winner must procure that its guest(s) comply with the Conditions of Sale and Conditions of Entry to the Event (copies of which are displayed at entrances to the Event or available at www.motogp.com.au). The winner agrees to make his or her guest(s) aware of the Conditions of Sale and Conditions of Entry to the Event. As a condition of accepting the prize, the winner and their Prize Companion may be required to sign a waiver of liability and indemnity form if, and in such form as, required by the Australian Grand Prix Corporation (AGPC).
p. The prize does not include return journey from Phillip Island, the winner and guest(s) need to make their own way home.
q. Total prize is valued at up to $33,708.00.
10. The prize must be taken as dictated above. If the prize winner can not take the prize during this time, the prize will be forfeited and another winner will be chosen.
11. Additional spending money, additional meals, taxes, additional insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
12. In the event that the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize for one of equal or greater value.
13. Prizes are not transferable and are not redeemable for cash. The judges’ decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
14. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize.
15. Neither the Promoter nor AGPC may be held responsible for any winner’s behaviour during the event or at the accommodation. Neither the Promoter nor AGPC shall be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of entering this competition, accepting and/or using a prize, except for any liability which cannot be excluded by law.
16. It is the sole responsibility of the winner to make all necessary arrangements to ensure their availability to the Event and to also receive the prize when the Promoter decides to provide the prize. All entrants to the competition (including the winner) acknowledge that it is their sole responsibility to follow all directives of the Promoter and AGPC regarding receipt of the prize and if not followed may result in the winner failing to receive the prize and in which case they shall not be entitled to receive any other prize, compensation or other form of entitlement in lieu.
17. If for any reason the winner can not participate in any part of the prize then they forfeit all parts of the prize.
18. WARNING UNDER THE FAIR TRADING ACT 1999
a. Under the provisions of the Fair Trading Act 1999 (Vic) several conditions are implied into contracts for the supply of certain goods and services. These conditions mean that the supplier named on this form is required to ensure that the recreational services it supplied are:
i. rendered with due care and skill; and
ii. as fit for the purpose for which they are commonly bought as it is reasonable to expect in the circumstances; and
iii. reasonably fit for any particular purpose or might reasonably be expected to achieve any result you have made known to the supplier.
b. Under section 32N of the Fair Trading Act 1999 (Vic), a supplier is entitled to ask a participant to agree that these conditions do not apply. By participating in the Activity the winner will be agreeing that any rights to sue the Organisers under the Fair Trading Act 1999 (Vic) if the winner is killed or injured because the services were not rendered with due care and skill or they were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these conditions.
c. NOTE: The change to the winner’s rights, as set out here, does not apply if death or injury is due to gross negligence on a supplier's part. "Gross negligence" is defined in the Fair Trading (Recreational Services) Regulations 2004.
d. The winner acknowledges that participation in the Activity, is voluntary and that the winner can withdraw at any time subject to these and any other terms and conditions.
19. We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
20. We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters.
21. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to, if applicable, any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
22. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to, if applicable, any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.
23. The Promoter reserves the right to request verification of the winner and their guest(s) of age, identity, motorcycle registration, motorcycle licence, residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.
24. The winner agrees to participate in any news media activities surrounding the promotion such as photographic shoots and interviews.

e. The tour operator is GET ROUTED and the winner must abide the tour operated terms and conditions as outlined below.

iii. Bike Shipping. Price includes the shipping of any bike which comes within the definition of STANDARD SIZE – i.e. less than 2.3 m long. YES, that’s LESS THAN 2.3 metres long. A container door is 2.3 m wide. We can take bigger/longer bikes – see the last page for additional costs.
iv. VISA’s - you don’t need a visa for any of the destinations shown on this itinerary if you are travelling on an Australian or New Zealand passport.
v. Departure - a minimum of 20 bikes (or less at our discretion) is required to ensure departure of this tour. If the tour is cancelled due to a shortage of participants all monies will be refunded.
vi. Shipments. We fit 20 bikes into each container and only ship full containers. It is envisaged that there will be containers out of Melbourne, Sydney, Brisbane and Perth. If there are more bikes than we can fit in a container (or not enough) the bikes may need to be moved to another port to make up the numbers for an extra container. Moving bikes to another port for loading is at your expense. Book early and it’s not a problem.
vii. Luggage. We can take some bike luggage in the container, but it must be bubble wrapped and off the bike when loaded. Panniers & Top boxes (hard & soft) can be taken in the container but must also be bubble wrapped to protect against damage – you take full responsibility for any luggage or panniers & Top Boxes in the container.
viii. Failure to comply will see someone upset on bike loading day. Happens every year – someone doesn’t read every word.
ix. As well, in the container we can take your helmet, riding boots, jacket & riding pants and wet weather suit. You are responsible for wrapping it to avoid damage. We can’t take tents or other personal effects.
x. Remember: -Top Boxes & Panniers MUST be off the bike at loading time.
xi. Bikes must be clean enough to pass rigid Quarantine inspections at both ends. This is your responsibility.

f. Travel to and from the start and end points of the tour is not included in the prize.

Conditions of entry for the 2wheels June 2010 Subscription competition.
1. Information on how to enter and the prizes form part of these conditions of entry. Entry into the competition is deemed acceptance of the terms and conditions.
2. The Promoter is News Magazines ABN 57 088 923 906. Employees of News Magazines and their advertising agencies, newsagents, subagents, respective employees and their immediate families are ineligible to enter.
3. Entry is open only to Australian residents over the age of 18 years who during the promotional period, subscribe for 6 months or more to 2Wheels magazine. Participants must provide their full name, address and contact phone number as a minimum requirement to be eligible to be in the draw and can subscribe by phone, online or by mailing in the coupon as advertised in 2Wheels magazine or by subscription renewal letter. The subscriptions must also be signed against a nominated valid credit card or, if paid by cheque, cleared for payment. The payer of a gift subscription will be entered into the draw (not the recipient).
4. Promotion commences 12:01am, Wednesday 18th May 2010 and closes 11.59pm, Tuesday 22nd June 2010 (the promotional period). All times refereed to are Australian Eastern Standard Time.

Winners will be notified in writing and phone within 2 days of the draw.
